Debt Recovery & Tracing
by Fixed Fee
Whatever the size of the debt, our fees are fixed.
We only advise to pursue a debt if we think there's a good chance of success.
Depending on your case, you will only need one or two of the services listed here.
INITIAL ACTIONS
In our experience, most cases are resolved at this stage.
Trace the Debtor..... £110+VAT
If you don't know where the tenant is, we try and track them down.
DOWNLOAD TRACE REQUEST FORM.
Letter Before Action..... £38+VAT
Sending a Letter Before Action allows us to apply to a court if the debt is not paid in full within seven days.
COURT ACTIONS
Depending on circumstances, there are different legal actions. All of them require drawing up papers, serving and making applications to court.
Small Claims Summons..... £255+VAT
Solicitors draft and prepare and then serve the debtor with a debt summons.
This will result in a money judgment being made against the debtor.
Attachment of Earnings..... £340+VAT
If you have a money judgement and know where the debtor works, we can apply to a Judge to order that the debtor repays the full debt directly from their earnings.
This is paid directly from the employer not the debtor.
Charging Order..... £425+VAT
If you know that the debtor owns a property (if you don't, we can again help you via our debtor tracing service), and you have a money judgment we apply to get a charging order on the property.
A charging order is an order from the court placed on a debtor's property (house or land).
Bankruptcy Demand..... £382+VAT
A statutory/bankruptcy demand gives a debtor 21 days warning to pay the debt. After the statutory demand has runs it's course, it can be followed by bankruptcy proceedings.
Winding Up Demand..... £382+VAT
A winding up/statutory demand gives a debtor 21 days warning to pay the debt. After the statutory demand has runs it's course, it can be followed by winding up proceedings at court.
ENFORCEMENT
The debtor will usually settle after a court action. But if not, registered bailiffs are instructed...
High Court Sheriff.... £294+VAT
We arrange to instruct the High Court Sheriff to go to the debtor's address and attempt to seize the debtor's goods.
Once goods are seized and the debtor still refuses to pay, the goods can be sold at auction to raise funds to pay off the debt.
Important Note
If the tenant still lives in your property, you must first use our eviction Steps 1 and 2 before any debt recovery can go ahead.
